4Penalties.
1
A person guilty of an offence under section 1 or 2 shall be liable—
a
on summary conviction to a fine not exceedingF1 level 5 on the standard scale or to imprisonment for a term not exceeding two years or to both such fine and such imprisonment;
b
on conviction on indictment to a fine of such amount as the court may think proper or to imprisonment for a term not exceeding five years or to both such fine and such imprisonment.

A person guilty of an offence under section 3 shall be liable on conviction on indictment to a fine of such amount as the court may think proper or to imprisonment for a term not exceeding ten years or to both such imprisonment and such fine.
