The Department of Health, Social Services and Public Safety(1) makes the following Regulations in exercise of the powers conferred by Articles 4, 6, 10(3) and 15(1) of, and paragraphs 5 and 8 of Schedule 1 to, the Smoking (Northern Ireland) Order 2006(2).

Citation and commencement

1.  These Regulations may be cited as the Smoke-free (Exemptions, Vehicles, Penalties and Discounted Amounts) (Amendment) Regulations (Northern Ireland) 2008 and shall come into operation on 1st September 2008.

Amendment of the Smoke-free (Exemptions, Vehicles, Penalties and Discounted Amounts) Regulations (Northern Ireland) 2007

2.—(1) The Smoke-free (Exemptions, Vehicles, Penalties and Discounted Amounts) Regulations (Northern Ireland) 2007(3) shall be amended in accordance with paragraph (2).

(2) In regulation 5(1) (Other residential accommodation) for the words “aged 16 years” there is substituted the words “aged 18 years”.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend regulation 5(1) of the Smoke-free (Exemptions, Vehicles, Penalties and Discounted Amounts) Regulations (Northern Ireland) 2007. The amendment to regulation 5(1) is linked to the raising of the age of sale of tobacco and cigarette papers from 16 years to 18 years of age.
