Coming into operation in accordance with Article 1

The Department of Justice, in exercise of the powers conferred by section 31(3) of the Justice Act (Northern Ireland) 2015(1), makes the following Order.

In accordance with section 28(1) of the Act the Department has issued a Victim Charter.

In accordance with section 31(2) of the Act the Department laid the Victim Charter before the Assembly on 14th September 2015.

Citation and commencement

1.  This Order may be cited as the Victim Charter (Justice Act (Northern Ireland) 2015) Order (Northern Ireland) 2015 and shall come into operation on the day following the date on which this Order is made.

Interpretation

2.  In this Order “the Act” means the Justice Act (Northern Ireland) 2015.

Date on which the Victim Charter comes into operation

3.  The Victim Charter, laid before the Assembly on 14th September 2015 under section 31(2) of the Act, shall come into operation on the same day as this Order comes into operation.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings the Victim Charter, which has been prepared and issued by the Department of Justice, into operation on xxx. The Charter is laid before the Assembly with this Order.

The Charter sets out the services which are to be provided to victims by specified criminal justice agencies and the standards which are to be expected in relation to those services as well as the standards which are to be expected in relation to the treatment of victims by such agencies.

The Charter also implements a range of obligations arising out of the EU Directive (2012/29/EU) establishing minimum standards on the rights, support and protection of victims of crime.

A transposition note, in respect of the Directive, is provided as an Annex to the Explanatory Memorandum associated with this Order. The Order and Explanatory Memorandum can be found at www.legislation.gov.uk. The Charter and the transposition note are available on the Department of Justice website.
