Offences with firearms
Use of firearm to resist arrest59

A person who makes any use whatsoever of a firearm or imitation firearm with intent to resist or prevent the lawful arrest or detention of himself or any other person shall be guilty of an offence.

A person who at the time of his committing, or of his being arrested for, an offence specified in Schedule 4 has in his possession a firearm or imitation firearm, shall be guilty of an offence under this paragraph unless he shows that he had it in his possession for a lawful purpose.

For the purposes of this Article, the definition of “firearm” in Article 2(2) shall apply as if paragraphs (b) and (c) were omitted.
