Redetermination of costs by Department13

Where a representative is dissatisfied with the calculation of the remuneration payable under Schedule 2, 3, 4 or 5 as applicable, the representative may apply to the Department to redetermine those costs.

Subject to Article 17, the application shall be made within 21 days of receiving notification of the remuneration payable under Article 11, by giving notice in writing to the Department specifying the matters in respect of which the application is made and the grounds of objection and shall be made in such form and manner as the Department may direct.

The notice of application shall be accompanied by the particulars, information and documents supplied under Article 8.

The applicant shall supply such further particulars, information and documents as the Department may require.

If the Department considers it necessary to receive oral representations, the Department shall inform the applicant of the date of any hearing and, subject to the provisions of this Article, may give directions as to the conduct of the hearing.

The Department shall redetermine the costs, whether by way of confirmation, or increase or decrease in the amount previously determined, in the light of the objections made by, or on behalf of, the applicant and shall notify the applicant of its decision.

The applicant may request the Department to give reasons in writing for its decision and the Department shall comply with any such request.

Subject to Article 17, any request under paragraph (7) shall be made within 21 days of receiving notification of the decision.
