The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 86(2) and (3) of the Road Traffic Regulation Act 1984(1) and all other powers enabling them to do so.

In accordance with section 86(9) of that Act, they have consulted with such representative organisations as they thought fit.

In accordance with section 86(8) of that Act, a draft of this instrument has been laid before and approved by resolution of the Scottish Parliament.

Citation and commencement

1.  These Regulations may be cited as the HGV Speed Limit (M9/A9 Trunk Road) Regulations 2014 and come into force 7 days after the day on which they are made.

Increased speed limit

2.  In Schedule 6 to the Road Traffic Regulation Act 1984 (speed limits for vehicles of certain classes)(2), in Part I after the Table insert—

For a vehicle falling within class 5(2)(b) above, the maximum speed while the vehicle is being driven on a part of the M9/A9 Trunk Road specified in the Schedule to the HGV Speed Limit (M9/A9 Trunk Road) Regulations 2014 is 50 miles per hour (rather than 40 miles per hour as specified in column 3(c) of the Table above)..

3.  The Schedule to these Regulations specifies the parts of the M9/A9 Trunk Road referred to in Part I of Schedule 6 to the Road Traffic Regulation Act 1984.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend Schedule 6 to the Road Traffic Regulation Act 1984 which sets speed limits in respect of particular classes of vehicle. The speed limit for a heavy goods vehicle falling within class 5(2)(b) in Part I of that Schedule is 40mph, except where the vehicle is being driven on a motorway or dual carriageway. These Regulations increase the speed limit for such a vehicle to 50mph when it is being driven on a single carriageway stretch of the M9/A9 Trunk Road specified in the Schedule to the Regulations. The relevant stretches all lie between Perth and Inverness.
