The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 12(1) and (2) of the Cost of Living (Tenant Protection) (Scotland) Act 2022(1) and all other powers enabling them to do so.
In accordance with section 12(5)(a) of that Act, a draft of this instrument has been laid before and approved by resolution of the Scottish Parliament.
1.—(1) These Regulations may be cited as the Cost of Living (Tenant Protection) (Scotland) Act 2022 (Incidental Provision) Regulations 2023.
(2) These Regulations come into force on the day after the day on which they are made.
2.—(1) Paragraph 1 of schedule 1 of the Cost of Living (Tenant Protection) (Scotland) Act 2022 is amended as follows.
(2) In sub-paragraph (17) (modifying the Private Housing (Tenancies) (Scotland) Act 2016(2) to treat new Chapter 2A of Part 4 of that Act as having been inserted), in the opening words, for “section 33” substitute “section 34A (inserted by paragraph 1(2) of schedule 3 of this Act)”.

These Regulations make incidental provision for the purposes of, and for giving full effect to, the Cost of Living (Tenant Protection)(Scotland) Act 2022. This will ensure that new section 34A is inserted in the Private Housing (Tenancies) (Scotland) Act 2016 as intended.
