The Scottish Ministers make the following Order in exercise of the powers conferred by section 21(1) of the Deer (Scotland) Act 1996(1) (“the 1996 Act”), and all other powers enabling them to do so.

In accordance with section 21(2) of the 1996 Act, the Scottish Ministers have consulted organisations which represent persons likely to be interested in or affected by the Order.

In accordance with section 21(4) of the 1996 Act, a draft of this instrument has been laid before and approved by resolution of the Scottish Parliament.

Citation and commencement

1.  This Order may be cited as the Deer (Firearms etc.) (Scotland) Amendment Order 2023 and comes into force on the day after the day on which it is made.

Amendment of the Deer (Firearms etc.) (Scotland) Order 1985

2.—(1) The Deer (Firearms etc.) (Scotland) Order 1985(2) is amended in accordance with paragraphs (2) and (3).

(2) In article 3(a), for “100 grains (6.48 grams)” substitute “80 grains (5.3 grams)”.

(3) In article 5, for paragraph (b) substitute—

(b)a sight of any type including light-intensifying, heat-sensitive or other special sighting device for night shooting..

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends articles 3 and 5 of the Deer (Firearms etc.) (Scotland) Order 1985.

The effect of this Order is to amend the specifications of bullets for the shooting of deer of any species by amending the minimum bullet weight. This will permit the use of non-lead ammunition, such as copper ammunition, in addition to lead ammunition.

Article 5(b) is amended to permit the use of light-intensifying, heat sensitive or other special sighting device for night shooting.
