The Scottish Ministers make the following Order in exercise of the powers conferred by section 15(2)(a) of the Public Services Reform (Scotland) Act 2010(1) and all other powers enabling them to do so.

In accordance with section 25(3)(a) and (4) of that Act, they have consulted the National Smart Ticketing Advisory Board.

In accordance with section 25(3)(b)(ii) of that Act, they have laid before the Scottish Parliament an explanatory document prepared in accordance with section 25(5).

In accordance with section 25(3)(b)(i) and (c) of that Act(2), a draft of this Order has been laid before and approved by resolution of the Scottish Parliament.

Citation and commencement

1.  This Order may be cited as the National Smart Ticketing Advisory Board (Public Services Reform) (Scotland) Order 2024 and comes into force on 27 April 2024.

Public Services Reform (Scotland) Act 2010

2.  In the Public Services Reform (Scotland) Act 2010, in schedule 5 (improvement of public functions: listed bodies)(3), under the heading “Scottish public authorities with mixed functions or no reserved functions”, after the entry relating to any National Park authority insert—

EXPLANATORY NOTE

(This note is not part of the Order)

This Order modifies schedule 5 of the Public Services Reform (Scotland) Act 2010 (“the 2010 Act”).

Schedule 5 of the 2010 Act is introduced by section 15 (public functions: further provision) of that Act and lists the persons, bodies and office-holders in respect of which the Scottish Ministers may, by order under section 14 of that Act, make any provision which they consider would improve the exercise of public functions having regard to efficiency, effectiveness and economy.

This Order inserts the National Smart Ticketing Advisory Board into the list of bodies in schedule 5 of the 2010 Act.

2010 asp 8 (“the 2010 Act”). Sections 14 to 30 and schedules 5 to 7 of the 2010 Act were to cease to have effect on 2 August 2015 by virtue of section 134(2) and (3) of the 2010 Act; however, sections 14 to 30 and schedules 5 to 7 continue to have effect until 5 May 2025 by virtue of S.S.I. 2015/234 and S.S.I. 2020/140.

Section 25(3)(b)(i) and (c) has been modified by paragraph 5(2) of schedule 3 of the Interpretation and Legislative Reform (Scotland) Act 2010 (asp 10).

Schedule 5 has been amended but none of the amendments are relevant to this Order.
