The Budget (Scotland) Act 2013 Amendment Order 2014

The Scottish Ministers make the following Order in exercise of the powers conferred by section 7(1) of the Budget (Scotland) Act 2013(1) and all other powers enabling them to do so.

In accordance with section 7(2) of that Act, a draft of this Order has been laid before and approved by resolution of the Scottish Parliament.

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Budget (Scotland) Act 2013 Amendment Order 2014 and comes into force on the day after the day on which it is made.

(2) In this Order, “the Act” means the Budget (Scotland) Act 2013.

Amendment of amounts specified in section 4 (overall cash authorisations)

2.  In section 4 of the Act, for the amount specified—

(a)in subsection (2) (Scottish Administration), substitute “£31,956,931,000”;

(b)in subsection (3)(a) (Forestry Commissioners), substitute “£70,031,000”; and

(c)in subsection (3)(c) (Scottish Parliamentary Corporate Body), substitute “£71,989,000”.

Amendment of schedule 1 (the Scottish Administration)

3.—(1) The table in schedule 1 to the Act is amended in accordance with paragraphs (2) and (3).

(2) In column 2 (amount of resources other than accruing resources), for the amount specified—

(a)in relation to purpose 1, substitute “216,415,000”;

(b)in relation to purpose 2, substitute “462,271,000”;

(c)in relation to purpose 3, substitute “12,004,657,000”;

(d)in relation to purpose 4, substitute “3,017,863,000”;

(e)in relation to purpose 5, substitute “2,559,608,000”;

(f)in relation to purpose 6, substitute “467,964,000”;

(g)in relation to purpose 7, substitute “2,588,219,000”;

(h)in relation to purpose 8, substitute “10,104,943,000”;

(i)in relation to purpose 10, substitute “216,411,000”;

(j)in relation to purpose 11, substitute “20,559,000”;

(k)in relation to purpose 12, substitute “109,900,000”;

(l)in relation to purpose 13, substitute “86,266,000”;

(m)in relation to purpose 15, substitute “4,966,000”; and

(n)in the final row, in relation to the total amounts of resources, substitute “34,530,670,000”.

(3) In column 3 (amount of accruing resources), for the amount specified—

(a)in relation to purpose 9, substitute “1,700,000,000”;

(b)in relation to purpose 11, substitute “9,700,000”; and

(c)in the final row, in relation to the total amounts of resources, substitute “5,091,600,000”.

Amendment of schedule 2 (direct-funded bodies)

4.—(1) The table in schedule 2 to the Act is amended in accordance with paragraphs (2) and (3).

(2) In column 1 (purpose)—

(a)in purpose 1 (Forestry Commissioners), for “grant in aid” substitute “grants”; and

(b)in purpose 3 (Scottish Parliamentary Corporate Body)—

(i)for the words from “the Commission” to “Commissioners for Scotland)”, substitute “the Commissioner for Ethical Standards in Public Life in Scotland”; and

(ii)after “People in Scotland;”, insert “payments to the Electoral Commission for costs associated with the Scottish independence referendum in 2014;”.

(3) In column 2 (amount of resources other than accruing resources)—

(a)in relation to purpose 1, substitute “70,131,000”;

(b)in relation to purpose 3, substitute “85,253,000”; and

(c)in relation to purpose 4, substitute “7,637,000”.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends the Budget (Scotland) Act 2013 (“the Act”).

Article 2 amends the overall cash authorisations specified in section 4(2) and (3) of the Act in relation to the Scottish Administration, the Forestry Commissioners and the Scottish Parliamentary Corporate Body.

Article 3(2) amends the amount of resources (other than accruing resources) that may be used for purposes 1 to 8, 10 to 13 and 15 in schedule 1 to the Act. It also amends the total amount of those resources for all the purposes in that schedule.

Article 3(3) amends the amount of accruing resources that may be used for purposes 9 and 11 in schedule 1 to the Act. It also amends the total amount of those resources for all the purposes in that schedule.

Article 4(2) amends purposes 1 and 3 for which resources may be used in accordance with section 2 of, and schedule 2 to, the Act.

Article 4(3) amends the amount of resources (other than accruing resources) that may be used by the Forestry Commissioners, the Scottish Parliamentary Corporate Body and Audit Scotland for certain purposes in schedule 2 to the Act.
