Sale of Goods (Amendment) Act 1994

1994 CHAPTER 32

An Act to abolish the rule of law relating to the sale of goods in market overt.

[3rd November 1994]

Be it enacted by the Queen’s most Excellent Majesty, by and with the advice and consent of the Lords Spiritual and Temporal, and Commons, in this present Parliament assembled, and by the authority of the same, as follows:—

1Repeal of s. 22(1) of the Sale of Goods Act 1979

Section 22 (1) (relating to the sale of goods in market overt) of the [1979 c. 54.] Sale of Goods Act 1979 is hereby repealed.

2Consequential Repeals

(1)Section 47 of the [1542 c. 26.] Laws in Wales Act 1542 (sale of stolen goods in a fair or market in Wales) is hereby repealed.

(2)In section 7(3) of the [1967 c. 83.] Sea Fisheries (Shellfish) Act 1967 (protection of fisheries for shellfish), the words “sold in market overt or” shall be omitted.

3Short title, commencement and extent

(1)This Act may be cited as the Sale of Goods (Amendment) Act 1994.

(2)This Act shall apply to any contract for sale of goods which is made after this Act comes into force.

(3)This Act shall come into force at the end of the period of two months beginning with the day on which it is passed.

(4)Section 1 and this section extend to Northern Ireland.
