Communications Act 2003

An Act to confer functions on the Office of Communications; to make provision about the regulation of the provision of electronic communications networks and services and of the use of the electro-magnetic spectrum; to make provision about the regulation of broadcasting and of the provision of television and radio services; to make provision about mergers involving newspaper and other media enterprises and, in that connection, to amend the Enterprise Act 2002; and for connected purposes.

Licensing of additional television services

Section 49 of the 1990 Act (licensing of additional television services) shall be amended as follows.

For “the Commission”, wherever occurring, there shall be substituted “ OFCOM ”.

In subsection (1), for the words from “of the following” to “48(1)(b)” there shall be substituted “ relevant frequency ”.

For subsections (2) and (3) there shall be substituted—

An additional services licence is not required for an additional service that is comprised in the public teletext service (within the meaning of Part 3 of the Communications Act 2003).

In subsection (10), at the end there shall be inserted “ and “relevant frequency” has the same meaning as in section 48. ”
