4(1)Any reference in this Schedule to a person operating in the financial sector is to a credit or financial institution that—U.K.
(a)is a United Kingdom person, or
(b)is acting in the course of a business carried on by it in the United Kingdom.
(2)This is subject to the exceptions in paragraph 6.
