SCHEDULE 3 E+W Special educational needs: consequential amendments

PART 1 E+W Amendments to the Education Act 1996

14 (1) Section 316A (education otherwise than in mainstream schools) is amended as follows. E+W

(2) In subsection (2)—

(a) in paragraph (a), for sub-paragraph (ii) substitute—

“(ii) the governing body of the school or, if the school is in England, its head teacher,”, and

(b) in paragraph (c), for sub-paragraph (ii) substitute—

“(ii) the governing body of the school or, if the school is in England, its head teacher,”.

(3) In subsection (8)—

(a) after “issued” insert “ by the Welsh Ministers ”, and

(b) omit paragraphs (a) and (b).

(4) In subsection (10)—

(a) omit “, in relation to Wales,”, and

(b) for “National Assembly for Wales” substitute “ Welsh Ministers ”.
