In subsection (5), after paragraph (a) insert—

an application for permission in principle for the development of any land;

In subsection (8), for “An application for planning permission is similar” substitute “
Subject to subsection (9), an application is similar
”
.

After that subsection insert—

An application within subsection (5)(a) or (b) is not similar to an earlier application within subsection (5)(aa).
