CHAPTER 1 E+W Custody: general provisions

General limits on powers to impose custodial sentences E+W

223 Two year limit on imprisonment for statutory offence if no maximum specified E+W

Where—

(a) a person is convicted on indictment of an offence under any enactment which is punishable with imprisonment, and

(b) no enactment—

(i) limits the sentence to a specified term, or

(ii) expresses it to extend to imprisonment for life,

the person is liable to imprisonment for not more than 2 years.
