TRANSPORT

The Transport Act 1985 (Commencement No. 6) (Amendment) Order 1988

The Secretary of State for Transport, in exercise of the powers conferred by section 140(2) and (3) of the Transport Act 1985(1), and of all other enabling powers, hereby makes the following Order:

1.  This Order may be cited as the Transport Act 1985 (Commencement No. 6) (Amendment) Order 1988 and shall come into force on 31st December 1988.

2.  In article 3 of the Transport Act 1985 (Commencement No. 6) Order 1986(2), for the words “1st January 1989” there shall be substituted the words “1st July 1989”.

Explanatory Note

(This note is not part of the Order)

Section 3(4) of the Road Traffic Regulation Act 1984 (c. 27) provided (with certain exceptions) that no prohibition or restriction on waiting imposed by a traffic regulation order made under section 1 of that Act was to apply to a stage carriage. Section 3(4) of the 1984 Act was repealed by Schedule 8 to the Transport Act 1985. The repeal was put into effect by the Transport Act 1985 (Commencement No. 6) Order 1986 on 26th October 1986.

The 1986 Order provided that until 1st January 1989, the repeal would not affect the operation, in relation to a public service vehicle being used in the provision of a local service, of any traffic regulation order made before 26th October 1986.

This Order amends that transitional provision so as to extend its operation until 1st July 1989.
