LAND DRAINAGE

The General Drainage Charges (Forms) Regulations 1990

The Minister of Agriculture, Fisheries and Food and the Secretary of State for Wales, in exercise of the powers conferred by sections 53(3) and 95 of the Land Drainage Act 1976(1), and now vested in them(2), and of all other powers enabling them in that behalf, hereby make the following Regulations:

Title, commencement and revocation

1.—(1) These Regulations may be cited as the General Drainage Charges (Forms) Regulations 1990 and shall come into force on 1st April 1990.

(2) The Drainage Charges (Forms) Regulations 1969(3) are hereby revoked.

Form of general drainage charges

2.  Every general drainage charge raised by the National Rivers Authority shall be in Form 1 set out in the Schedule to these Regulations or in a form substantially to the like effect.

Form of demand for general drainage charges

3.  Every demand for payment of a general drainage charge raised by the National Rivers Authority shall be in Form 2 set out in the Schedule to these Regulations or in a form substantially to the like effect.

SCHEDULE

FORM 1general drainage charge

The National Rivers Authority, in exercise of the powers conferred on them by section 48 of the Land Drainage Act 1976, following the recommendation of theRegional Flood Defence Committee, hereby raise for the year ending on 31st March 19 a general drainage charge ofper hectare of chargeable land in theLocal Flood Defence District.

The Common Seal of the National Rivers Authority is hereunto affixed on 19 pursuant to a resolution of the Authority dated 19.

Explanatory Note

(This note is not part of the Regulations)

These Regulations, which apply to England and Wales, supersede the Drainage Charges (Forms) Regulations 1969. The Regulations prescribe the form to be used for raising general drainage charges and the form of demand for such charges. The forms are based on the principal forms relating to general drainage charges in the Schedule to the 1969 Regulations which have been adapted to meet the altered basis on which such drainage charges may be raised under section 48 of the Land Drainage Act 1976, as amended (in particular) by the Water Act 1989. No form is prescribed in relation to special drainage charges.
