Regulation 27(2) (exception for statutory authority) is amended as follows.

After paragraph (2)(a) insert—

a Measure or Act of the National Assembly for Wales;

After sub-paragraph (2)(c) insert—
d
an instrument made after the end of the initial period under an Act, or under a Measure or Act of the National Assembly for Wales, by the Welsh Ministers, the First Minister for Wales or the Counsel General to the Welsh Assembly Government.

In paragraph (2)(d) “the initial period” has the same meaning as in the Government of Wales Act 2006 (see section 161(6) of that Act).
