Substitution of article 1879

For article 18 substitute—

Notification of results of application18

This article applies where a person (“A”) applies to have his name registered in Part 1 or 2 of the Register of Pharmacists.

The Registrar, within the period of one month beginning with the date of receipt of the application, must—

a

acknowledge receipt of the application; and

b

inform A of any missing document required for the purposes of the application.

The Registrar must, within the specified period, notify A—

a

of the result of the application; and

b

if the Registrar refuses the application, of the reasons for the decision, and of any right of appeal A has to the Registration Appeals Committee.

In paragraph (3) “the specified period”—

a

except in a case specified in sub-paragraph (b), means the period of three months beginning with the relevant date;

b

if A's application is made on the grounds that he is appropriately qualified by virtue of article 12(1)(ba), means the period of four months beginning with the relevant date.

The “relevant date”, in relation to an application, is—

a

the date when the Registrar receives the application; or

b

if any document required for the purposes of the application, or the relevant fee, is missing when the Registrar receives the application, the date on which the Registrar first has all the documents required for those purposes together with the relevant fee.
