The A46 Trunk Road (A46/M40 Junction 15 (Longbridge) Bypass) (Detrunking) Order 2007

The Secretary of State for Transport makes this Order in exercise of powers conferred by section 10 of the Highways Act 1980(1) and now vested in her(2):-

1.  This Order may be cited as the A46 Trunk Road (A46/M40 Junction 15 (Longbridge) Bypass) (Detrunking) Order 2007. and shall come into force on 1st February 2008.

2.  In this Order—

(i)“the new trunk roads” means the new highways which the Secretary of State proposes to construct referred to in article 2(2)(ii) of the A46 Trunk Road (A46/M40 Junction 15 (Longbridge) Bypass) Order 2007(3); and

(ii)“the trunk road” means the Stratford to Warwick Trunk Road (A46).

3.  The length of the trunk road described in the Schedule to this Order shall cease to be a trunk road from the date on which the Secretary of State notifies the Warwickshire County Council that the new trunk roads are open for traffic.

THE SCHEDULELENGTH OF THE TRUNK ROAD CEASING TO BE A TRUNK ROAD

The length of the trunk road ceasing to be a trunk road is located on the A46 Stratford to Warwick southbound carriageway from a point approximately 23 metres north east of the Watery Lane junction with the A46 to a point approximately 160 metres south west of the Vicarage Lane junction with the A46 for a distance of 386 metres and is shown by broad black dashes on the plan numbered HA 10/MP/083, marked “The A46 Trunk Road (A46/M40 Junction 15 (Longbridge) Bypass) (Detrunking) Order 2007” signed by authority of the Secretary of State for Transport, and deposited at DfT Records Management Branch, Floor 13 (IMD), Ashdown House, St Leonards on Sea, Hastings, East Sussex TN37 7GA.

Explanatory Note

(This note is not part of the Order)

The southbound carriageway of the existing A46 between Sherbourne Fruit Farm (on the west of Vicarage Lane) and the A46/M40 Junction 15 (Longbridge) roundabout detrunked by this Order has been replaced by the new trunk road. The detrunked part of the southbound carriageway is to remain as a public highway and will be improved to form a new two way local access road.

The northbound carriageway of the existing A46 between Sherbourne Fruit Farm (on the west of Vicarage Lane) and the A46/M40 Junction 15 (Longbridge) roundabout has been replaced by the new trunk road. The redundant trunk road is stopped up by the associated Side Roads Order. After the carriageway is closed, the land will be used for environmental mitigation measures.
