44.  In regulation 1(2) of the Social Security (Payments on account, Overpayments and Recovery) Regulations 1988(1) (citation, commencement and interpretation) in the definition of “adjudicating authority” for the words “an appeal tribunal” to the end substitute “the First-tier Tribunal or the Upper Tribunal;”.

S.I. 1988/664. These regulations have been revoked in so far as they relate to child benefit or guardian’s allowance by the Child Benefit and Guardian’s Allowance (Administration) Regulations 2003 (S.I. 2003/492). In regulation 1(2) the definition of “adjudicating authority” was substituted by paragraph 1 of Schedule 9 to the Social Security Act 1998 (Commencement No 12 and Consequential and Transitional Provisions) Order 1999 (S.I. 1999/3178).
