Subsections (1) and (2) of section 5 were amended by paragraph 29(1) and (2) of Schedule 10 to the Tribunals, Courts and Enforcement Act 2007 (c.15) and subsection (1) was also amended by article 2(1) of, and the Schedule to, the Transfer of Functions (Lord Advocate and Secretary of State) Order 1999 (S.I. 1999/678).
