The Enterprise and New Towns (Scotland) Act 1990 is amended as follows.

In section 4(2) (functions of Scottish Enterprise to be carried on through company or partnership), for “within the meaning of the Companies Act 1985” substitute “ as defined in section 1(1) of the Companies Act 2006 ”.

In section 8(1) (powers of Scottish Enterprise and Highlands and Islands Enterprise), in paragraph (l) (formation and promotion of companies) for “(within the meaning of the Companies Act 1985)” substitute “ under the Companies Act 2006 ”.

In section 36(1) (interpretation), in the definition of “subsidiary” and “wholly-owned subsidiary” for “section 736 of the Companies Act 1985” substitute “ section 1159 of the Companies Act 2006 ”.
