The Secretary of State for Health makes the following Regulations in exercise of the powers conferred by sections 8(1), 12A(4), 12B(1) to (4), 12C(1) to (6), 75, 272(7) and (8) and 273(4) of the National Health Service Act 2006(1).
2006 c. 41. Sections 12A to 12D were inserted by section 11 of the Health Act 2009 (c. 21) (“the 2009 Act”). See section 275 of the National Health Service Act 2006 (“the NHS Act”) for the definitions of “prescribed” and “regulations”. By virtue of section 271 of the NHS Act, the powers conferred on the Secretary of State by the Act, as exercised in making these Regulations, are exercisable only in relation to England.
