21.—(1) The NHS Bodies and Local Authorities Partnership Arrangements Regulations 2000(1) are amended as follows.
(2) In regulation 5 of those Regulations (functions of NHS bodies), after paragraph (b), insert—
“(bb)the functions of making direct payments under—
(i)section 12A(1) of the National Health Service Act 2006 (direct payments for health care)(2); and
(ii)regulation 2(7) of the National Health Service (Direct Payments) Regulations 2010”.
S.I. 2000/617 (“the 2000 Regulations”). Following the consolidation of enactments relating to the health service by the National Health Service Act 2006 (c. 41), the 2000 Regulations have effect as if made under section 75 of that Act, by virtue of paragraph 1 of Part 1 of Schedule 2 to the National Health Service (Consequential Provisions) Act 2006 (c. 43).
