The Secretary of State makes the following Regulations in exercise of the powers conferred by section 96(10) of the Transport Act 1968(1) and now vested in him(2) and section 2(2) of the European Communities Act 1972(3).

The Secretary of State is a Minister designated for the purposes of section 2(2) in relation to the regulation of the type, description, construction or equipment of vehicles(4), the regulation and supervision of working conditions of persons engaged in road transport(5) and measures relating to the organisation of working time(6).

The exercise of the powers conferred by section 2(2) in relation to Regulation (EC) No 561/2006 of the European Parliament and of the Council(7) has been authorised by the Commission of the European Communities in accordance with Article 14(1) of that Regulation.

In relation to the exercise of the powers conferred by section 96(10) of the Transport Act 1968 representative organisations have been consulted in accordance with section 101(6) of that Act.

The power in section 96(10) of the Transport Act 1968, to which there are amendments not relevant to these Regulations, became vested in the Secretary of State by virtue of the Secretary of State for the Environment Order 1970 (S.I.1970/1681), article 2.
