Section 136 (supporting maintenance agreements) is amended as follows.

In subsection (1), in subsection (2A) to be inserted into section 9 of the 1991 Act—

a

for “Commission” (in the first place) substitute “Secretary of State”;

b

in paragraph (a), for “it” substitute “the Secretary of State”; and

c

in paragraph (b), for “Commission” substitute “Secretary of State”.

In subsection (2), in sub-paragraph (3) to be inserted into paragraph 3 of Schedule 5 to the 2008 Act, for “Commission” (in both places) substitute “Secretary of State”.
