The Lord President of the Council is a minister designated for the purposes of section 2(2) of the European Communities Act 19721 in relation to the European Parliament2.

The Lord President of the Council makes these Regulations in exercise of the powers conferred by sections 2(2), 6(5) and 7 of the European Parliamentary Elections Act 20023, sections 17 and 18 of the European Parliament (Representation) Act 20034 and section 2(2) of the European Communities Act 1972.

The Lord President of the Council has consulted the Electoral Commission in accordance with section 7(1) and (2)(a) of the Political Parties, Elections and Referendums Act 20005 and with section 17(4) of the European Parliament (Representation) Act 2003.

In accordance with section 13(2) of the European Parliamentary Elections Act 2002, section 18(4) of the European Parliament (Representation) Act 2003 and paragraph 2(2) of Schedule 2 to the European Communities Act 19726 a draft of these Regulations has been laid before and approved by a resolution of each House of Parliament.
