Where both—
a
a grant to a right to representation under section 14 of the 1999 Act which was granted before 1st April 2013; and
b
a determination for representation for the purposes of criminal proceedings under section 16 of the Act,
exist in the same proceedings, the Criminal Defence Service (Funding) Order 2007 applies and the Criminal Legal Aid (Remuneration) Regulations 201322 do not apply.
