Schedule 2 (exempt facilities: general) has effect.

Schedule 3 (exempt facilities and waste operations to which section 33(1)(a) of the 1990 Act does not apply: descriptions and conditions) has effect.

Section 33(1)(a) of the 1990 Act M1—

a

does not apply to an operation which—

i

falls within a description in Part 5 of Schedule 3, and

ii

meets the conditions specified in that Part for that description, and

b

does not apply to extractive waste at any time before the requirement for an environmental permit under regulation 12 applies in respect of the deposit of that waste.
