PART 2Non-compliance penalties and recovery of penalties and costs

Power to recover a variable monetary penalty or non-compliance penalty 10

After the end of the period for payment of—

a

a variable monetary penalty;

b

a non-compliance penalty; or

c

costs specified in an enforcement cost recovery notice,

the Agency may recover from the person on whom the penalty was imposed, or the notice served, the amount of the penalty or costs.

The amount of the penalty or costs may be recovered as a civil debt, or, on the order of the court, as if payable under a court order.
