Appeals against automatic removal from the register27

A person may appeal to the High Court against a determination by the regulator to remove their entry from the register under regulation 26(5), on the ground that the determination was based on an error of fact or of law.

An appeal under paragraph (1) must be made within 28 days of the day on which the person is notified that the regulator proposes to remove their entry from the register.

On an appeal under paragraph (1) the High Court may—

a

dismiss the appeal,

b

set aside the determination, or

c

remit the case to the regulator to dispose of in accordance with the directions of the court,

and may make any order as to costs as it thinks fit.
