These Regulations are made in exercise of the powers conferred by section 8(1) of the European Union (Withdrawal) Act 2018 (c. 16) in order to address failures of retained EU law to operate effectively and other deficiencies in retained EU law (in particular to address reciprocal arrangements which no longer exist and are no longer appropriate) arising from the withdrawal of the UK from the European Union.

Amendment of the Parental Responsibility and Measures for the Protection of Children (International Obligations) (England and Wales and Northern Ireland) Regulations 2010I137

The Parental Responsibility and Measures for the Protection of Children (International Obligations) (England and Wales and Northern Ireland) Regulations 2010 M1 are amended as follows.

In regulation 2 (interpretation)—

a

omit the definition of “the Council Regulation”;

b

omit the definition of “member State”.

In regulation 5 (local authorities: application for interim care order or supervision order)—

a

in paragraph (1)—

i

at the end of sub-paragraph (b)(i) insert “ or ”;

ii

omit sub-paragraph (b)(iii) and the “or” which precedes it;

b

in paragraph (2)—

i

in sub-paragraph (a), in the substituted subsection (1)(a) and (b) of section 38 of the Children Act 1989, omit sub-paragraph (b)(iii) and the “ or ” which precedes it;

ii
