CHAPTER 1 U.K. Amendment of Commission Regulation on initial airworthiness

Amendment of Subpart H of Section A of Annex 1 to Commission Regulation (EU) No 748/2012 U.K.

201.—(1) Section A, Subpart H (certificates of airworthiness and restricted certificates of airworthiness) is amended as follows.

(2) In point 21.A.172, for “a Member State (‘Member State of registry’)” substitute “the United Kingdom”.

(3) In point 21.A.173, in point (b)(2) for “Agency” substitute “CAA”.

(4) In point 21.A.174—

(a) in point (a) for “competent authority of the Member State of registry” substitute “CAA”;

(b) in point (b)—

(i) in point (2)(i)—

(aa) in the second indent for “competent authority” substitute “CAA”;

(bb) in the third indent for “Agency” substitute “CAA”;

(ii) in point (3)—

(aa) in point (i) for “a Member State” substitute “the United Kingdom”;

(bb) in point (ii) for “a non-Member State” substitute “another state”;

(c) in point (c), for “competent authority of the Member State of registry” substitute “CAA”.

(5) In point 21.A.175, for the words from “one or more of” to the end substitute “English”.

(6) In point 21.A.177, for “competent authority of the Member State of registry” substitute “CAA”.

(7) In point 21.A.179—

(a) in the heading, omit “within Member States”;

(b) for point (a) substitute—

“(a) Where ownership of an aircraft has changed, it remains on the United Kingdom register, and it has either a certificate of airworthiness or a restricted certificate of airworthiness conforming to a restricted type-certificate only, that certificate or restricted certificate (as the case may be) must be transferred together with the aircraft.”;

(c) for point (b) substitute—

“(b) Where ownership of an aircraft has changed, it remains on the United Kingdom register, and the aircraft has a restricted certificate of airworthiness not conforming to a restricted type-certificate, that restricted certificate must be transferred together with the aircraft.”.

(8) In point 21.A.180, for “competent authority of the Member State of registry” substitute “CAA”.

(9) In point 21.A.181(b), for “competent authority of the Member State of registry” substitute “CAA”.
