Transitional and saving provision: Monitor’s annual accounts and annual report10

This regulation applies where, immediately before 1st July 2022, a duty (the “undischarged duty”) imposed under the following provisions of Schedule 8 to the 2012 Act had not been discharged in respect of any period before 1st July 2022—
a
paragraph 19 (Monitor annual accounts);
b
paragraph 21(1) to (3) (Monitor annual report).

The provision which imposes the undischarged duty continues to apply—
a
so far as it relates to the undischarged duty; and
b
where the duty is imposed on Monitor, as if the undischarged duty were imposed on NHS England.
