6.—(1) Article 8 is amended as follows.
(2) In paragraph (3), for “apply unless” substitute “do not apply if”.
(3) After paragraph (4) insert—
“(5) For the purposes of this article, costs include costs—
(a)to any person; and
(b)to the environment.”
