The persons specified for the purposes of subsection (2) are—
a
the Secretary of State (subject to subsections (3) and (4) below);
b
the Environment Agency, if the determination is in relation to a supply of water that would affect water resources in England;
c
the NRBW, if the determination is in relation to a supply of water that would affect water resources in Wales.
