304.—(1) Mae adran 221 wedi ei diwygio fel a ganlyn.
(2) Ar ôl y diffiniad o “analyse” mewnosoder—
““the appropriate agency” means—
for the purposes of the flood risk management work provisions—
in relation to flood risks (within the meaning of the Flood and Water Management Act 2010) in Wales, the NRBW;
in any other case, the Agency;
for any other purpose—
in relation to Wales, the NRBW;
in any other case, the Agency;”.
(3) Yn y diffiniad o “flood defence functions”—
(a)yn lle “the Agency”, yn y man cyntaf lle y mae'n digwydd rhodder “the appropriate agency”;
(b)ym mharagraff (b), ar ôl “those functions” mewnosoder “of the appropriate agency which were previously”;
(c)ym mharagraff (c), yn lle “the Agency” rhodder “the appropriate agency”.
(4) Ar ôl y diffiniad o “flood defence provisions” mewnosoder—
““flood risk management work provisions” means—
sections 159(1A), 160(1A), 165 and 166; and
any other provision of Part 7 so far as it relates to a provision falling within paragraph (a);”.
(5) Ar ôl y diffiniad o “notice” mewnosoder—
““the NRBW” means the Natural Resources Body for Wales;”.
(6) Yn y diffiniad o “public authority”, ar ôl “the Agency,” mewnosoder “the NRBW,”.
(7) Yn y diffiniad o “the related water resources provisions”, ym mharagraff (b)(ii), ar ôl “subsections (1)” mewnosoder “, (1A)”.
(8) Yn y diffiniad o “watercourse”, ar ôl “Agency” mewnosoder “, the NRBW,”.
(9) Yn y diffiniad o “water pollution provisions”, yn y geiriau cau, ar ôl “subsections (1)” mewnosoder “, (1A)”.
(10) Ar ôl is-adran (1) mewnosoder—
“(1A) For the purposes of the definition of “the appropriate agency” in subsection (1), “Wales” has the meaning given by section 158 of the Government of Wales Act 2006.”
