364.—(1) Mae adran 5 wedi ei diwygio fel a ganlyn.
(2) Yn is-adran (1), yn lle “The Agency's” rhodder “An appropriate agency's”.
(3) Yn is-adran (2), yn lle “The Agency” rhodder “An appropriate agency”.
(4) Yn is-adran (3)—
(a)yn y geiriau agoriadol—
(i)yn lle “either of the Ministers” rhodder “the appropriate national authority”;
(ii)yn lle “the Agency”, rhodder “an appropriate agency”;
(b)ym mharagraff (a), yn lle “that Minister” rhodder “the appropriate national authority”;
(c)ym mharagraff (b)—
(i)yn lle “that Minister” rhodder “the appropriate national authority”;
(ii)yn lle “Agency” ym mhob man lle y mae'n digwydd, rhodder “appropriate agency”.
(5) Yn is-adrannau (4) a (5), yn lle “the Agency” rhodder “an appropriate agency”.
(6) Ar ôl is-adran (5) mewnosoder—
“(6) But in relation to the Natural Resources Body for Wales, “pollution control powers” and “pollution control functions” do not include powers or functions which—
(a)were exercisable by the Countryside Council for Wales or the Forestry Commissioners immediately before 1 April 2013; and
(b)are functions of that Body by virtue of the Natural Resources Body for Wales (Functions) Order 2013.”
