Section 56(1) is amended as follows.

In the appropriate places insert the following definitions—

  • “appropriate agency” means the Agency or the Natural Resources Body for Wales;

“the appropriate national authority” means—

a

in relation to the Agency, the Secretary of State;

b

in relation to the Natural Resources Body for Wales, the Welsh Ministers;

In the following definitions, for “the Agency”, in each place where it occurs, substitute “ an appropriate agency ”

a

the definition of “environmental licence” which applies in relation to the Agency; and

b

the definition of “flood defence functions”.
