Regulation 2 is amended as follows.

Before the definition of “Category A mining waste facility” insert—
“the 2010 Regulations” means the Environmental Permitting (England and Wales) Regulations 2010;

In the appropriate place insert—
“regulator” means—
a
the Natural Resources Body for Wales where that body is the regulator of the mining waste facility under the 2010 Regulations;
b
the Environment Agency, where that body is the regulator of the mining waste facility under the 2010 Regulations;
