The Equality Act 2010 (Public Authorities subject to the Public Sector Equality Duty) (Wales) Order 2021

The Welsh Ministers make the following Order in exercise of the powers conferred on them by sections 151(2) and 207(2) of the Equality Act 2010(1).

In accordance with section 209(2) and (3)(b) of that Act, a draft of this Order has been laid before and approved by resolution of Senedd Cymru.

Prior to making this Order, in accordance with section 152(2) of the Equality Act 2010, the Welsh Ministers have consulted the Equality and Human Rights Commission.

Title and coming into force

1.  The title of this Order is the Equality Act 2010 (Public Authorities subject to the Public Sector Equality Duty) (Wales) Order 2021 and will come into force on 1 April 2021.

Amendment of Schedule 19 to the Equality Act 2010

2.  In Part 2 of Schedule 19 to the Equality Act 2010 (Public Authorities: Relevant Welsh Authorities), under the heading ‘Local government’ in the appropriate place, insert—

A corporate joint committee established by regulations made under Part 5 of the Local Government and Elections (Wales) Act 2021.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order amends Part 2 of Schedule 19 to the Equality Act 2010 (“the Act”) by adding corporate joint committees established by regulations made under Part 5 of the Local Government and Elections (Wales) Act 2021 (asc 1) to the list of relevant Welsh authorities subject to the Public Sector Equality Duty under section 149(1) of the Act.

The relevant Welsh authorities specified in Part 2 of Schedule 19 to the Act are authorities that satisfy the test in section 157(2) of the Act; that is they are ‘devolved Welsh authorities’ within the meaning given by section 157A of the Government of Wales Act 2006.

This Order is connected with Regulations which establish certain corporate joint committees under Part 5 of the Local Government and Elections (Wales) Act 2021 (asc 1). The Welsh Ministers’ Code of Practice on the carrying out of Regulatory Impact Assessments was considered in relation to the Regulations which establish corporate joint committees and connected regulations and orders. As a result a regulatory impact assessment has been prepared. A copy can be obtained at Local Government Strategic Finance Division, Welsh Government, Cathays Park, Cardiff, CF10 3NQ.

2010 c. 15. Section 151(2) enables Welsh Ministers to amend Part 2 of Schedule 19 by Order, to add a relevant Welsh authority to the authorities that are subject to the public sector equality duty under section 149(1). A relevant Welsh authority is defined in section 157(2). Section 157(2) was substituted by paragraph 84(2) of Schedule 6 to the Wales Act 2017 (c. 4).
