Protection from Eviction Act 1977E+W

9.—(1) The Protection from Eviction Act 1977(1) is amended as follows.

(2) In section 5(2) (validity of notices to quit)—

(a)in subsection (1A)(3), for “subsection (1B)”, substitute “subsections (1B) and (1C)”, and

(b)after subsection (1B)(4), insert—

(1C) Because of section 232 (forfeiture and notices to quit) of the Renting Homes (Wales) Act 2016 (anaw 1), this section does not apply to a dwelling in Wales which is subject to an occupation contract.

(3) In section 8(5) (interpretation), in subsection (1), after paragraph (g), insert—

(h)an occupation contract within the meaning of the Renting Homes (Wales) Act 2016 (anaw 1) (see section 7 of that Act).

Section 8 was amended by section 100 of and paragraph 61 of Schedule 14 to the Agricultural Holdings Act 1986 (c. 5), section 40 of, and paragraph 29(a) and (b) of the Schedule to, the Agricultural Tenancies Act 1995 (c. 8), sections 33(2) and 44(2)(b) of the Housing Act 1988 (c. 50) and section 194(1) of and paragraph 54 of Schedule 11 to the Local Government and Housing Act 1989 (c. 42). There are other amendments to section 8 which are not relevant to these Regulations.
