35.—(1) Regulation 6 (permitted work) of the Hedgerows Regulations 1997(1) is amended as follows.
(2) In paragraph (1)(h)—
(a)after “Secretary of State” insert “or a strategic highways company”;
(b)after “his” insert “or its”;
(c)after “he”, wherever occurring, insert “or it”;
(3) After paragraph (3) insert—
“(4) In paragraph (1)(h) “strategic highways company” means a company for the time being appointed under Part 1 of the Infrastructure Act 2015(2).”.
