Ar hyn o bryd nid oes unrhyw effeithiau heb eu gweithredu yn hysbys ar gyfer y Deddf Rheoleiddio ac Arolygu Gofal Cymdeithasol (Cymru) 2016, Adran 62.
Efallai na fydd deddfwriaeth ddiwygiedig sydd ar y safle hwn yn gwbl gyfoes. Ar hyn o bryd mae unrhyw newidiadau neu effeithiau hysbys a wnaed gan ddeddfwriaeth ddilynol wedi'u gwneud i destun y ddeddfwriaeth yr ydych yn edrych arni gan y tîm golygyddol. Gweler 'Cwestiynau Cyffredin' am fanylion ynglŷn â'r amserlenni ar gyfer nodi a chofnodi effeithiau newydd ar y safle hwn.
Rhagolygol
(1)Mae’r adran hon yn gymwys pan fo Gweinidogion Cymru wedi eu bodloni bod darparwr gwasanaeth y mae adran 61 yn gymwys iddo yn debygol o beidio â gallu darparu gwasanaeth rheoleiddiedig y mae wedi ei gofrestru mewn cysylltiad ag ef oherwydd methiant busnes fel a grybwyllir yn adran 189 o Ddeddf 2014 (methiant darparwr: dyletswydd dros dro ar awdurdod lleol).
(2)Rhaid i Weinidogion Cymru hysbysu’r awdurdodau lleol y maent yn meddwl y bydd yn ofynnol iddynt gyflawni’r ddyletswydd o dan adran 189(2) o Ddeddf 2014 os yw’r darparwr gwasanaeth yn peidio â gallu darparu’r gwasanaeth rheoleiddiedig o dan sylw.
(3)Caiff Gweinidogion Cymru ei gwneud yn ofynnol i’r darparwr gwasanaeth, neu unrhyw berson arall sy’n ymwneud â busnes y darparwr gwasanaeth sy’n briodol yn eu barn hwy, ddarparu unrhyw wybodaeth y maent yn meddwl ei bod yn angenrheidiol neu’n hwylus iddynt ei chael at ddiben cynorthwyo awdurdod lleol i gyflawni’r ddyletswydd o dan adran 189(2) o Ddeddf 2014.
(4)Ond ni chaiff Gweinidogion Cymru ei gwneud yn ofynnol i berson ddarparu gwybodaeth os yw datgelu’r wybodaeth honno wedi ei wahardd drwy unrhyw ddeddfiad neu reol gyfreithiol arall.
(5)Mae’r pŵer i’w gwneud yn ofynnol i wybodaeth gael ei darparu o dan is-adran (3) yn cynnwys—
(a)pŵer i’w gwneud yn ofynnol i gopïau gael eu darparu o unrhyw ddogfennau neu gofnodion (gan gynnwys cofnodion meddygol a chofnodion personol eraill), a
(b)pŵer i’w gwneud yn ofynnol i’r wybodaeth gael ei darparu ar ffurf ddarllenadwy.
