Defnyddir y term darpariaeth i ddisgrifio elfen ddiffiniadwy mewn darn o ddeddfwriaeth sy'n cael effaith ddeddfwriaethol – megis Rhan, Pennod neu adran. Mae fersiwn o ddarpariaeth yn rhagolygol naill ai:

  1. os nad yw'r ddarpariaeth (Rhan, Pennod neu adran) erioed wedi dod i rym neu;
  2. pan fo testun y ddarpariaeth wedi'i newid, ond nad oes dyddiad wedi'i bennu eto gan y person neu'r corff priodol i'r newidiadau hynny i ddod i rym.

Gall Gorchmynion Cychwyn a restrir yn y blwch 'Newidiadau i Ddeddfwriaeth' fel rhai sydd heb eu gwneud eto ddod â'r fersiwn ragolygol hon i rym.

Changes to Legislation

Efallai na fydd deddfwriaeth ddiwygiedig sydd ar y safle hwn yn gwbl gyfoes. Ar hyn o bryd mae unrhyw newidiadau neu effeithiau hysbys a wnaed gan ddeddfwriaeth ddilynol wedi'u gwneud i destun y ddeddfwriaeth yr ydych yn edrych arni gan y tîm golygyddol. Gweler 'Cwestiynau Cyffredin' am fanylion ynglŷn â'r amserlenni ar gyfer nodi a chofnodi effeithiau newydd ar y safle hwn.

(1)Rhaid i gytundeb partneriaeth adeilad rhestredig fod yn ysgrifenedig.

(2)Rhaid i gytundeb partneriaeth adeilad rhestredig—

(a)cynnwys digon o wybodaeth i adnabod yr adeilad rhestredig y mae’n ymwneud ag ef, gan gynnwys plan;

(b)cynnwys unrhyw blaniau eraill ac unrhyw luniadau eraill sy’n angenrheidiol i ddisgrifio unrhyw waith y mae’n ymwneud ag ef;

(c)pennu’r dyddiad y mae’n cymryd effaith a’i hyd;

(d)gwneud darpariaeth i’r partïon adolygu telerau’r cytundeb ar ysbeidiau a bennir ynddo;

(e)gwneud darpariaeth ar gyfer ei amrywio (ond mae hyn yn ddarostyngedig i reoliadau o dan is-adran (5));

(f)gwneud darpariaeth ar gyfer ei derfynu (ond mae hyn yn ddarostyngedig i adran 115).

(3)Caiff cytundeb partneriaeth adeilad rhestredig gynnwys darpariaeth ddeilliadol a darpariaeth ganlyniadol.

(4)Caiff Gweinidogion Cymru drwy reoliadau bennu telerau eraill y mae rhaid eu cynnwys mewn cytundeb partneriaeth adeilad rhestredig.

(5)Rhaid i Weinidogion Cymru drwy reoliadau wneud darpariaeth ynghylch—

(a)yr ymgynghoriad y mae rhaid ei gynnal cyn i gytundeb partneriaeth adeilad rhestredig gael ei wneud neu ei amrywio;

(b)y cyhoeddusrwydd y mae rhaid ei roi i gytundeb partneriaeth adeilad rhestredig cyn neu ar ôl iddo gael ei wneud neu ei amrywio.

(6)Wrth ystyried pa un ai i wneud cytundeb partneriaeth adeilad rhestredig sy’n rhoi cydsyniad adeilad rhestredig, neu amrywio cytundeb fel ei fod yn rhoi cydsyniad, rhaid i awdurdod cynllunio neu Weinidogion Cymru roi sylw arbennig i ddymunoldeb diogelu—

(a)yr adeilad rhestredig y mae’r cytundeb yn ymwneud ag ef,

(b)safle’r adeilad, ac

(c)unrhyw nodweddion o ddiddordeb pensaernïol neu hanesyddol arbennig sydd gan yr adeilad.

(7)Ni chaiff cytundeb partneriaeth adeilad rhestredig osod unrhyw rwymedigaeth neu unrhyw atebolrwydd ar berson nad yw’n barti i’r cytundeb, na rhoi unrhyw hawl i berson o’r fath; ac nid yw cydsyniad adeilad rhestredig a roddir gan gytundeb o’r fath yn cael effaith ond er budd y partïon iddo.

(8)Caiff Gweinidogion Cymru drwy reoliadau—

(a)datgymhwyso, neu gymhwyso neu atgynhyrchu gydag addasiadau neu hebddynt, unrhyw ddarpariaeth yn adrannau 90 i 104 (rhoi cydsyniad adeilad rhestredig) neu Bennod 4 (gorfodi) at ddibenion cytundebau partneriaethau adeiladau rhestredig, a

(b)darparu i unrhyw ddarpariaeth arall yn y Ddeddf hon fod yn gymwys gydag addasiadau sy’n ganlyniadol ar ddarpariaeth a wneir o dan baragraff (a).
