8Datganiadau niferoedd ac amcangyfrifon

(1)Caiff Gweinidogion Cymru roi cyfarwyddiadau yn ei gwneud yn ofynnol i bersonau sy'n atebol i dalu ardoll mewn perthynas ag unrhyw gyfnod gyflwyno datganiad ynghylch y cyfnod hwnnw.
(2)Rhaid i'r datganiad gynnwys—
(a)nifer y gwartheg, defaid neu foch y gellir codi ardoll amdanynt am y cyfnod y mae'r datganiad yn ymwneud ag ef, a
(b)unrhyw fanylion eraill a bennir gan Weinidogion Cymru.
(3)Rhaid i'r datganiad gael ei gyflwyno erbyn y dyddiad, ac yn y modd a'r ffurf, a bennir mewn cyfarwyddyd a roddir gan Weinidogion Cymru.
(4)Os bydd unrhyw berson sy'n atebol i gyflwyno datganiad—
(a)yn methu â chyflwyno'r datganiad erbyn y dyddiad a bennir,
(b)yn methu â chynnwys amcangyfrif yn y datganiad o nifer y gwartheg, defaid neu foch y gellir codi ardoll amdanynt, neu
(c)yn cynnwys amcangyfrif yn y datganiad sydd, ym marn Gweinidogion Cymru, yn afresymol o isel,
caiff Gweinidogion Cymru amcangyfrif nifer yr anifeiliaid a ddylai fod wedi ei nodi yn y datganiad.
(5)Os bydd Gweinidogion Cymru yn amcangyfrif nifer yr anifeiliaid yn unol ag is-adran (4), rhaid iddynt hysbysu'r person sy'n atebol i dalu'r ardoll yn ysgrifenedig o'r amcangyfrif hwnnw.
(6)Wedi iddo gael ei hysbysu o'r amcangyfrif, os bydd y person sy'n atebol i dalu'r ardoll yn methu â chyflwyno datganiad yn cynnwys amcangyfrif o fewn 28 niwrnod o dderbyn yr hysbysiad, rhaid i'r person hwnnw dalu ardoll ar nifer yr anifeiliaid a amcangyfrifwyd.
(7)Caiff Gweinidogion Cymru bennu bod cyfradd uwch o ardoll yn daladwy pan fo nifer yr anifeiliaid wedi ei amcangyfrif ganddynt hwy o dan yr adran hon, ond rhaid i'r gyfradd honno beidio â bod yn uwch nag unrhyw uchafswm ar gyfradd ardoll a ddarperir o dan y Mesur hwn.
(8)Mae person sy'n methu, heb esgus rhesymol, â chyflwyno datganiad yn unol â gofynion unrhyw gyfarwyddyd yn euog o dramgwydd sy'n dwyn cosb, ar gollfarn ddiannod, o ddirwy heb fod yn uwch na lefel 5 ar y raddfa safonol.
(9)Mae person sy'n darparu gwybodaeth anwir neu gamarweiniol mewn perthynas ag unrhyw ofynion o dan y Mesur hwn yn euog o dramgwydd sy'n dwyn cosb, ar gollfarn ddiannod, o ddirwy heb fod yn uwch na lefel 5 ar y raddfa safonol.
