8Y Confensiwn ar Hawliau'r Plentyn

(1)Yn y Mesur hwn—
(a)ystyr “y Confensiwn” yw Confensiwn y Cenhedloedd Unedig ar Hawliau'r Plentyn a fabwysiadwyd ac a agorwyd i'w lofnodi, ei gadarnhau a'i gytuno gan benderfyniad y Cynulliad Cyffredinol 44/25 20 Tachwedd 1989, a
(b)ystyr “y Protocolau” yw'r Protocolau Dewisol a grybwyllir yn adran 1(1)(b) ac (c).
(2)Yn yr Atodlen i'r Mesur hwn—
(a)mae Rhan 1 yn rhoi testun Rhan I o'r Confensiwn,
(b)mae Rhan 2 yn rhoi testun erthyglau'r Protocolau y cyfeirir atynt yn adran 1(1)(b) ac (c), a
(c)mae Rhan 3 yn rhoi testun y datganiadau gan y Deyrnas Unedig i'r Confensiwn a'r Protocolau.
(3)At ddibenion y Mesur hwn, mae'r Confensiwn a'r Protocolau i'w trin fel petai iddynt effaith—
(a)fel y'u rhoddir am y tro yn Rhannau 1 a 2 o'r Atodlen, ond
(b)yn ddarostyngedig i unrhyw ddatganiad neu neilltuad fel y'u rhoddir am y tro yn Rhan 3 o'r Atodlen.
(4)Mae is-adran (5) yn gymwys os yw'r Deyrnas Unedig wedi llofnodi neu wedi mynegi fel arall ei chytundeb i—
(a)diwygiad i'r Confensiwn neu i brotocol a roddir am y tro yn yr Atodlen, neu
(b)protocol ychwanegol i'r Confensiwn.
Ond nid yw'r is-adran honno yn gymwys os yw is-adran (7) yn gymwys o ran y diwygiad neu'r protocol.
(5)Caiff Gweinidogion Cymru wneud drwy orchymyn ddiwygiadau i adran 1(1), 8(1), 8(2) neu 8(3) o'r Mesur hwn neu i'r Atodlen i'r Mesur hwn i adlewyrchu—
(a)y diwygiad neu'r protocol, a
(b)unrhyw ddatganiad neu neilltuad gan y Deyrnas Unedig i'r diwygiad neu i'r protocol.
(6)Mae is-adran (7) yn gymwys os yw'r Deyrnas Unedig wedi cadarnhau—
(a)diwygiad i'r Confensiwn neu i brotocol a roddir am y tro yn yr Atodlen, neu
(b)protocol ychwanegol i'r Confensiwn.
(7)Rhaid i Weinidogion Cymru wneud drwy orchymyn ddiwygiadau i adran 1(1), 8(1), 8(2) neu 8(3) o'r Mesur hwn neu i'r Atodlen i'r Mesur hwn i adlewyrchu—
(a)y diwygiad neu'r protocol, a
(b)unrhyw ddatganiad neu neilltuad gan y Deyrnas Unedig i'r diwygiad neu i'r protocol.
(8)Rhaid i Weinidogion Cymru wneud drwy orchymyn ddiwygiadau i Ran 3 o'r Atodlen i adlewyrchu unrhyw weithred o ddiwygio neu dynnu yn ôl o unrhyw ddatganiad neu neilltuad a roddir am y tro yn y Rhan honno.
