Adran 51 - Arfer pwerau gorfodi

116.Mae'r adran hon yn mewnosod adran 50B newydd yn Neddf 1996. Mae'r adran newydd hon yn gymwys pan fo Gweinidogion Cymru yn penderfynu a ydynt am arfer pŵer gorfodi ai peidio, pa bŵer i'w arfer, neu sut i arfer pŵer. Mae'n darparu bod rhaid i Weinidogion Cymru, ymhob un o'r amgylchiadau hyn, ystyried:

(a)

buddioldeb gadael i LCCau fod yn rhydd i ddewis sut i ddarparu gwasanaethau a gweithredu'u busnes;

(b)

a yw'r methiant neu'r broblem arall dan sylw naill ai'n ddifrifol neu'n ddibwys.

(c)

a yw'r methiant neu'r broblem arall dan sylw naill ai'n ddigwyddiad cyson neu'n ddigwyddiad eithriadol;

(ch)

pa mor gyflym y mae angen mynd i'r afael â'r methiant neu'r broblem arall.

117.Mae is-adran (3) yn diffinio ‘enforcement power’ (‘pŵer gorfodi’) fel pŵer sydd i'w arfer o dan unrhyw un neu ragor o'r darpariaethau statudol a restrir yn yr is-adran honno.
